No buildings, water, power connections on Peravallur lake: Madras HC

CHENNAI: Flagging encroachment of the Peravallur lake in Kolathur, the Madras high court has stayed any form of construction on the lake bed, and restrained Tangedco and Metrowater from providing power and water connections there until further orders.

A division bench of Justice N Kirubakaran and Justice T V Thamilselvi has also directed CMDA, the Greater Chennai Corporation and revenue department officials to ascertain the extent of encroachment made by ‘land sharks’ in the waterbody. The joint inspection team has also been directed to file a status report on the extent of encroachment, construction thereon with photographs by July 6.

“It is a classic case of a waterbody being killed with the help of officials by land encroachers by getting patta illegally, for which the revenue authorities have got no jurisdiction. Waterbodies are lifelines of human beings. Without water no living being like man can survive,” the court said.

According to the petitioner, about 250 to 350 acres of land comprised the lake, government poromboke land and smaller waterbodies like ponds. However, officials, in collusion with land-grabbers, had illegally issued pattas to a major portion of the area.

Highlighting the issue, the petitioner made several representations to the authorities. Since no action was taken on the complaints, the present PIL was filed in the high court.

Recording the submissions, the judges said: “Prima facie, this court is convinced that private parties had obtained patta illegally in respect of waterbody, which is not sustainable in law…”

Asserting that no construction can be allowed in such illegally obtained land, the court added, “Otherwise, the illegality will be completed, and the people will be deprived of water resources.”
