CASE LAW MASTERCLASS-BASICS
Judgment Reading Technique – Kisi Bhi Valuation Judgment
Judgment = Court’s reasoned decision, अर्थात Court ने केवल यह नहीं बताया कि कौन जीता/हारा, बल्कि क्यों जीता/हारा, उसका reasoning भी दिया। यही सबसे Important बात है।
Court documents, Sale instances, location, size, development, time gap
Master Formula
Facts Issue Laws-Evidence Arguments Reasoning -Decision Ratio Valuation Application
Simple
Part 3 – Step 1: Facts
फिर dispute court me गया।
- Land
- Area
- Nearby development
- Claimant
- Facts
Part 4 – Step 2: Parties
Parties = मुकदमे में शामिल पक्ष। आपको पहचानना है: कौन किसके खिलाफ है?
Common Words & Meanings:
| Word | Simple Meaning | Word | Simple Meaning |
| Acquiring Authority | Land acquire करने वाली authority | State/Government | सरकारी पक्ष |
Example:
- Land owner: Compensation
- Government / Requiring Authority: Compensation
Part 5 – Step 3: Issue (सबसे important step)
Issue = Court के सामने वास्तविक कानूनी / तथ्यात्मक प्रश्न।
- Example:-
Golden Rule:
Part 6 – Step 4: Applicable Laws
- Land Acquisition Act
- Market Value
- Compensation
- Comparable Sales , Sale Instance , Exemplar
- Development , Potentiality
- Notification date
Important Distinction: Law not equal to Fact
Part 7 – Step 5: Evidence
Evidence = Court के सामने रखा गया material जिससे कोई fact/principle establish करने की कोशिश होती है।
Sale deeds, registered sale transactions, Valuation reports, Location evidence, Maps, Development evidence, Previous awards, Comparable transactions, Documentary records.
Example: तीन Sale Transactions
| Sale | Distance | Rate |
| A | 100 m | Rs 10 lakh |
| B | 500 m | Rs 15 lakh |
| C | 2 km | Rs 25 lakh |
Location, Size, Date, Nature of land, Development, Similarity, Transaction genuineness.
Part 8 – Step 6: Arguments
Arguments = दोनों पक्ष Court को क्या समझाने की कोशिश कर रहे हैं।
IBBI Trap: Argument Court का conclusion.
Part 9 – Step 7: Court’s Reasoning
Reasoning = Court ने किसी conclusion तक पहुँचने के लिए जो logic दिया। यहीं से आपकी Legal thinking develop होगी।
Court
Sale instance
Observation✖️🟰 Reasoning✖️🟰Decision ✖️🟰 Ratio
Part 11 – Ratio Decidendi
- लेकिन Ratio यह है: Court ने कहा – “Reliable comparable sale instances should be preferred after considering relevant differences.” to yh principle hai.
Memory Trick:
Part 12 – Obiter Dicta
Memory Trick:
- Ratio = Decision
Part 13 – Valuation Connection
- Lesson for Valuer: Valuer
| ● Loacation ->Time-> Size-> Land characterestics->Development->Transactio genuineness->Adjustments – >Reliable Indication of Market Value. |
“The claimant relied upon a sale deed of a nearby property. However, the said property was considerably smaller and situated in a more developed locality. The court therefore did not consider the transaction directly comparable without appropriate adjustment.”
- Evidence: Sale Deed.
- Decision: Without appropriate adjustment, direct comparison
Part 15 – IBBI Examiner’s Trap
Question Scenario: “A Sale instance is geographically proximate to the subject property. Therefore, it is the best comparable.”
Trap Words (जब options में ये absolute words आएं, तो alert हो जाइए):
Always, Automatically, Solely, Irrespective of, Without adjustment, In all cases, Necessarily, Only.
Legal Glossary:
| Legal Word | Meaning | Legal Word | Meaning |
Master Diagram
| Judgement ->Facts-> Parties->Issue-> Applicable law -> Evidence -> Arguments -> Courts reasoning -> Decision / Holding -> Ratio Decidendi -> Valuation application-> IBBI Exam Trap. |
5 Question Self Test
- a) Ratio
- b) Facts
- c) Obiter
- d) Holding
Ans: (b) Facts
- a) Issue
- b) Evidence
- c) Arguments
- d) Fact
Ans: (a) Issue
- a) Ratio
- b) Fact
- c) Decision / Conclusion
- d) Obiter
Ans: (c) Decision / Conclusion
- a) Correct
- b) Incorrect
Ans: (b) Incorrect (क्योंकि proximity alone पर्याप्त नहीं है।)
Q5. Valuation Judgment
- a) केवल final amount
- b) only Parties
Principle
Principle
Golden Rule
