CASE LAWS STUDY NOTES
LAND ACQUISITION & VALUATION
EPISODE 2
CASE 1: MANO ALEX V. UNION OF INDIA
NHAI LAND ACQUISITION COMPENSATION
Union of India”: NHAI इस Case में Respondent No. 2 है। यह Kerala High Court, WP(C) No. 10240/2020, decided 2 April 2025, Justice Viju Abraham का Judgment है।
Part 2 – Parties
- Petitioners: Mano Alex + Andrew Alex
- Respondents:
- Union of India
- National Highways Authority of India (NHAI)
- Project Director, NHAI
State of Kerala & authorities bhi implead हुई।
Memory:
- Mano Alex = Land owner side
- Union / NHAI = Acquisition side
Part 3 – Issue
Part 4 – Applicable Law
- Section 3A: Acquisition notification
- Section 3I: Competent Authority for Land Acquisition (CALA)
Part 5 – Petitioner’s Argument
- Land पहले ही Converted थी;
- 2008 Act से पहले Conversion हुआ था;
- Property data bank से remove हो चुकी थी;
Part 6 – NHAI / Government
Part 7 – Court’s Reasoning
Union of India के principle को refer किया।
Part 8 – “Comprehensive Enquiry”
Comprehensive = व्यापक / हर relevant factor को देखकर।
| S.No. | Factor | Description |
| 1 | Document of title | Ownership / title documents. |
| 2 | Physical nature of property | |
| 3 | Purpose for which land was used | Acquisition
| 6 | Nature of road | Property |
| 7 | Ease of access | Property
Concept
Revenue Record not equal to Entire Market Value Evidence
Nilam / Paddy land
Part 10 – “One Input”
Key Rule: Revenue record is relevant, but it is not necessarily the only determinant of market value.
Revenue record important evidence है, लेकिन market value determination का पूरा answer only revenue record नहीं है।
Valuer’s Mind Matrix (जब आप कोई Property inspect करें):
──► [ Then form Professional Valuation Conclusion ]
Part 12 – Court
Important:
- Court’s role here: Not equal to direct final valuation calculation directly.
- Court’s role: Proper statutory compensation enquiry
Part 13 – Natural Justice Connection
Court
“Competent authority shall issue notice before determining compensation and Petitioner shall be afforded an opportunity of being heard.”
- Opportunity of hearing:
Audi Alteram Partem (Hear the other side).
Part 14 – Ab Ratio
Practical / Core Valuation Takeaway:
Land acquisition compensation में market value determination, only revenue-record Classification पर mechanically आधारित नहीं होनी चाहिए; Competent authority को relevant evidence और property के relevant characteristics को लेकर comprehensive enquiry करनी चाहिए।
एक Line में: “Revenue entry is an input, not the entire valuation.”
Practical Connection
- Land = 10,000 sqft
- Revenue record: Agricultural / wetland
- Inspection में: 8 years old building, Road frontage, developed neighbourhood, electricity/water, nearby commercial activity, actual use residential, supporting conversion documents.
Revenue record says agricultural, therefore value = agricultural rate.”
आपको assignment purpose और applicable legal framework के अनुसार all relevant evidence & circumstances analyse करने होंगे।
Part 16 – IBBI Trap Questions
- Trap 1 Statement: “For land acquisition compensation, revenue records are irrelevant.”
- Answer: Wrong.
- Trap 2 Statement: “Revenue records alone are sufficient to determine market value.”
- Answer: Wrong. Comprehensive enquiry
- Trap 3 Statement: “The Court itself finally fixed the compensation amount in Mano Alex.”
- Answer: Wrong.
- Trap 4 Statement: “Physical nature of land is irrelevant if revenue record is available.”
- Answer: Wrong. Physical nature specifically relevant factor है।
- Trap 5 Statement: “Fair value Notification alone determines market value.”
- Answer: Wrong. Fair Value information relevant input है; लेकिन Comprehensive enquiry required है।
Part 17 – सबसे बड़ा IBBI Word Trap
- अगर question में लिखा हो: “CALA shall determine compensation solely on the basis of revenue records” तुरंत alert!
- लेकिन: “Revenue records may be considered” यह different Statement है।
Difference: Relevant not equal to Sole determinant – legal language की subtlety है!
| Step | Mano Alex Analysis |
| Facts | NHAI land acquisition; classification/compensation dispute. |
| Parties | Mano Alex vs. Union of India / NHAI etc. |
| Issue | Compensation mein Land nature / market value कैसे determine हो? |
| Law | National Highways Act, 1956 – Sections 3A, 3G, 3G(7), 3I. |
| Evidence | Revenue records, data-bank removal, land nature, relevant documents etc. |
| Arguments | Petitioner: Purayidom treatment; Authorities: Statutory Section 3G process. |
| Reasoning | Comprehensive enquiry; revenue entry alone is insufficient. |
| Decision | Claim to be considered in Section 3G enquiry with hearing & evidence. |
| Core Principle | Market value determination requires relevant comprehensive enquiry. |
| Valuation Connection | Documents + Physical nature + Use + Locality + Development + Access + Market evidence. |
- Revenue Record: Paddy / Nilam
- Ground Reality: Converted land
- Locality: Developed
- Access: Good
- Supporting Documents: Available
- Court’s conceptual response: “No, Look at the whole picture.”
Memory Code: Document + Ground + Use + Location}+ Development + Access
Legal Distinction
“Court Said Rs.X” और “Court directed authority to consider Rs.X” में अंतर है।
Difficult Legal Words
| Legal Word | आसान Meaning | Legal Word | आसान Meaning |
| Data Bank | Official land classification list | Grievance |
| CALA | Competent Authority for Land Acquisition | Adverting to | ध्यान देते हुए / consider करते हुए |
Part 22 – Final Exam Revision Card
====================================================================
MANO ALEX V. UNION OF INDIA
====================================================================
Court: Kerala High Court
Date: 02/04/2025
Core Subject: NHAI Land acquisition compensation
Important Provisions: NH Act, 1956 – Sections 3A, 3G, 3G(7), 3I
Main Valuation Lesson:
Market value determination should not be mechanically confined to
revenue-record entries; relevant evidence and characteristics of the
property require comprehensive consideration.
One Line Memory: “Revenue record अकेला valuation नहीं है।”
====================================================================
Self Test:
- (a) केवल Stamp duty
- (b) Land classification और compensation determination [Correct]
- (c) Rental Capitalization
- (d) Depreciation
- No.
- अगर Option में लिखा हो: “Revenue record is the sole basis for compensation” – आपका brain तुरंत क्या बोलेगा?
- Solely = Trap Alert!
Judgment = Court’s reasoned decision, अर्थात Court ने केवल यह नहीं बताया कि कौन जीता/हारा, बल्कि क्यों जीता/हारा, उसका reasoning भी दिया। यही सबसे Important बात है।
Court documents, Sale instances, location, size, development, time gap
Master Formula
Facts Issue Laws-Evidence Arguments Reasoning -Decision Ratio Valuation Application
Simple
Part 3 – Step 1: Facts
फिर dispute court me गया।
- Land
- Area
- Nearby development
- Claimant
- Facts
Part 4 – Step 2: Parties
Parties = मुकदमे में शामिल पक्ष। आपको पहचानना है: कौन किसके खिलाफ है?
Common Words & Meanings:
| Word | Simple Meaning | Word | Simple Meaning |
| Acquiring Authority | Land acquire करने वाली authority | State/Government | सरकारी पक्ष |
Example:
- Land owner: Compensation
- Government / Requiring Authority: Compensation
Part 5 – Step 3: Issue (सबसे important step)
Issue = Court के सामने वास्तविक कानूनी / तथ्यात्मक प्रश्न।
- Example:-
Golden Rule:
Part 6 – Step 4: Applicable Laws
- Land Acquisition Act
- Market Value
- Compensation
- Comparable Sales , Sale Instance , Exemplar
- Development , Potentiality
- Notification date
Important Distinction: Law not equal to Fact
Part 7 – Step 5: Evidence
Evidence = Court के सामने रखा गया material जिससे कोई fact/principle establish करने की कोशिश होती है।
Sale deeds, registered sale transactions, Valuation reports, Location evidence, Maps, Development evidence, Previous awards, Comparable transactions, Documentary records.
Example: तीन Sale Transactions
| Sale | Distance | Rate |
| A | 100 m | Rs 10 lakh |
| B | 500 m | Rs 15 lakh |
| C | 2 km | Rs 25 lakh |
Location, Size, Date, Nature of land, Development, Similarity, Transaction genuineness.
Part 8 – Step 6: Arguments
Arguments = दोनों पक्ष Court को क्या समझाने की कोशिश कर रहे हैं।
IBBI Trap: Argument Court का conclusion.
Part 9 – Step 7: Court’s Reasoning
Reasoning = Court ने किसी conclusion तक पहुँचने के लिए जो logic दिया। यहीं से आपकी Legal thinking develop होगी।
Court
Sale instance
Observation✖️🟰 Reasoning✖️🟰Decision ✖️🟰 Ratio
Part 11 – Ratio Decidendi
- लेकिन Ratio यह है: Court ने कहा – “Reliable comparable sale instances should be preferred after considering relevant differences.” to yh principle hai.
Memory Trick:
Part 12 – Obiter Dicta
Memory Trick:
- Ratio = Decision
Part 13 – Valuation Connection
- Lesson for Valuer: Valuer
| ● Loacation ->Time-> Size-> Land characterestics->Development->Transactio genuineness->Adjustments – >Reliable Indication of Market Value. |
“The claimant relied upon a sale deed of a nearby property. However, the said property was considerably smaller and situated in a more developed locality. The court therefore did not consider the transaction directly comparable without appropriate adjustment.”
- Evidence: Sale Deed.
- Decision: Without appropriate adjustment, direct comparison
Part 15 – IBBI Examiner’s Trap
Question Scenario: “A Sale instance is geographically proximate to the subject property. Therefore, it is the best comparable.”
Trap Words (जब options में ये absolute words आएं, तो alert हो जाइए):
Always, Automatically, Solely, Irrespective of, Without adjustment, In all cases, Necessarily, Only.
Legal Glossary:
| Legal Word | Meaning | Legal Word | Meaning |
Master Diagram
| Judgement ->Facts-> Parties->Issue-> Applicable law -> Evidence -> Arguments -> Courts reasoning -> Decision / Holding -> Ratio Decidendi -> Valuation application-> IBBI Exam Trap. |
5 Question Self Test
- a) Ratio
- b) Facts
- c) Obiter
- d) Holding
Ans: (b) Facts
- a) Issue
- b) Evidence
- c) Arguments
- d) Fact
Ans: (a) Issue
- a) Ratio
- b) Fact
- c) Decision / Conclusion
- d) Obiter
Ans: (c) Decision / Conclusion
- a) Correct
- b) Incorrect
Ans: (b) Incorrect (क्योंकि proximity alone पर्याप्त नहीं है।)
Q5. Valuation Judgment
- a) केवल final amount
- b) only Parties
Principle
Principle
Golden Rule
