UNDERSTANDING UNAUTHORIZED CONSTRUCTION, COMPOUNDING, REGULARISATION & DEMOLITION LAW

Land legality + Planning legality + Building Bye-Laws + Procedural legality.

Professional investigation

  • Ground Coverage
  • Required setbacks
  • Building height permissible
  • Parking requirements
  • Fire safety requirements

इसलिए “No Plan Approval” एक starting point है—final legal conclusion नहीं।

2. Land Use

Example

Case Example – A

residential plot + permissible residential use + building plan में minor deviation

  • FAR: 2.00
  • Maximum Ground Coverage: 50%
  • Front Setback: 5 metres
  • Side Setback: 3 metres
  • Maximum Height: 15 metres

Nature, extent and consequences of each violation

5. Real-Life Judicial Example: Ludhiana

इसका structural/planning impact क्या है?

Ramesh Verma v.

“No map approval = no demolition.”

“No map approval requires legal and technical scrutiny; demolition, regularisation or compounding depends upon the applicable law and the facts of the case.”

8. Demolition Notice

Step 1 — Notice

Check

  • किस section/rule के तहत?
  • Property identification

Land Documents

  • Sale Deed
  • Conveyance Deed
  • Jamabandi/Revenue Record
  • Mutation
  • Site/Location Plan
  • Land-use permission, wherever applicable

Planning Documents

  • Master Plan
  • Zonal Plan
  • Layout Plan
  • Sector Plan
  • Road alignment / widening information
  • Applicable zoning regulations

Building Documents

  • Approved Building Plan, if any
  • Previous permissions
  • Completion/Occupancy Certificate, if any
  • Previous notices
  • Compounding applications/orders
  • Photographs
  • Actual site measurements

Notice Proceedings

  • Show Cause Notice
  • Inspection Report
  • Demolition Order
  • Reply filed
  • Hearing record
  • Appeal/revision papers

10. Engineer/Architect

Site Measurement Sheet

Parameter Permissible Existing Deviation
Plot Area — — —
Ground Coverage — — —
FAR — — —
Front Setback — — —
Rear Setback — — —
Side Setback — — —
Height — — —
No. of Floors — — —
Parking — — —

In Re: Directions in the Matter of Demolition of Structures, (2025) 5 SCC 1 decision

Owner

Property tax assessment ≠ building approval.

Electricity connection ≠ building sanction.

Water connection ≠ planning permission.

Long possession ≠ automatic regularisation.

A. Title

क्या ownership/right in property establish है?

B. Land Use

C. Building Approval

D. Actual Construction

E. Regulatory Deviation

F. Regularisation/Compounding

G. Litigation/Notice

क्या demolition notice, court case या municipal proceeding pending है?

H. Valuation Impact

Property tax primarily taxation/assessment purpose

“The building has been duly sanctioned under the applicable building laws.”

Documents में plot area 200 sq.yd. है।

Actual site पर:

  • sanctioned plan उपलब्ध नहीं,
  • तीन floors constructed हैं,
  • Master Plan residential use permit

“The valuation is subject to verification of title, sanctioned building permission, conformity with applicable building bye-laws, land-use regulations and absence/pending status of statutory proceedings.”

17. एक hypothetical valuation example

Market value of compliant building: ₹1.50 crore

लेकिन actual property में:

  • 20% additional construction,
  • setback deviation,
  • no occupancy certificate,
  • municipal notice pending.

“Total built-up area × prevailing market rate = ₹1.50 crore”

क्या demolition/alteration risk है?

क्या compounding legally available है?

यही legal and regulatory risk valuation analysis में relevant हो सकता है।

Possible situations

Situation 1:
Minor deviation + applicable compounding provision available + prescribed conditions satisfied.

→ Statutory compounding/regularisation route potentially relevant.

Situation 2:
Major deviation + non-compoundable violation.

→ Demolition/removal of offending portion may become a legal possibility.

Situation 3:
Construction partly sanctioned, partly unauthorized.

Situation 4:
Construction on Government/public land.

→ Land encroachment issue independently serious

Situation 5:
Construction in prohibited/restricted zone.

→ Ordinary compounding provisions may not provide a solution.

Situation 6:
Demolition notice issued without prescribed procedural safeguards.

→ Notice/order की legal validity and available remedies may require examination.

Regularisation

  • statute-specific,
  • location-specific,
  • time-specific,
  • condition-specific

Professional Checklist

OWNER CHECKLIST

2. Service date note करें।

3. Statutory deadline calculate करें।

4. Site का fresh measurement कराएं।

5. Actual construction drawing

6. Master Plan/Zonal Plan verify करें।

7. Applicable Building Bye-Laws identify करें।

8. FAR, coverage, setback, height calculate करें।

9. Compoundable/non-compoundable provisions check करें।

10. Land ownership और land-use documents verify करें।

11. Existing court/municipal proceedings check करें।

12. Time-bound reply file करें।

13. Personal hearing attend करें।

Professional Approach

Unauthorized construction inspection

“Approved / Not Approved”

LEGAL STATUS MATRIX

Land Title
↓
Land Use
↓
Master/Zonal Plan
↓
Building Permission
↓
Actual Site Construction
↓
Deviation Analysis
↓
Compoundability
↓
Notice / Litigation Status
↓
Regularisation Possibility under Applicable Law
↓
Valuation / Marketability Impact

Unauthorized Construction

Encroachment

किसी दूसरे के land/right, विशेषकर Government/public land, पर unauthorized occupation/construction का प्रश्न।

24. The Bottom Line

“No sanctioned plan = immediate bulldozer” भी एक legally incomplete statement है।

सही approach है:

पहले land status देखिए।
फिर land use देखिए।
फिर Master/Zonal Plan देखिए।
फिर Building Bye-Laws apply कीजिए।
फिर actual construction measure कीजिए।
फिर deviations identify कीजिए।
फिर compoundability/regularisation provisions देखिए।

For Engineers & Valuers

“Measure the building. Read the bye-laws. Verify the land use. Examine the notice. Identify the exact deviation. Never confuse tax assessment with building approval—and never confuse the possibility of regularisation with an actual right to regularisation.”

  • apartment,
  • commercial complex,
  • industrial building,
  • warehouse,
  • farmhouse,
  • institutional property

Building laws, Master Plans, zoning regulations, compounding provisions और demolition procedures State/UT तथा local authority के अनुसार अलग हो सकते हैं।
