OBLIGATIONS AND RIGHTS OF INSURER AND INSURED

The relationship between an insurer and an insured is governed by a contract known as an insurance policy. The insurer is the party who agrees to provide financial protection to the insured in the event of certain specified risks, while the insured is the party who pays a premium for that protection.

The obligations and rights of both the insurer and the insured are outlined in the insurance policy, and may vary depending on the type of insurance and the specific terms of the policy. However, some general obligations and rights of each party include:

Obligations of the insurer:

  • To investigate claims made by the insured in a timely manner

Obligations of the insured:

  • To pay premiums in a timely manner
  • To disclose all relevant information when applying for coverage
  • To cooperate with the insurer during the claims process
  • To mitigate damages and take steps to prevent further loss

Key points of Obligations of the Insured:

  1. Duty of Disclosure: The insured has a duty to provide truthful and accurate information to the insurer when applying for insurance, and to notify the insurer of any changes that may affect the policy.
  2. Duty to Pay Premiums: The insured must pay the premiums on time in order to maintain coverage.
  3. Duty to Mitigate Losses: The insured has a duty to take reasonable steps to mitigate their losses after an insured event has occurred.
  4. Duty to Cooperate: The insured has a duty to cooperate with the insurer in the investigation and settlement of claims.
