DIFFERENCE BETWEEN NUISANCE & TRESPASS AS PER LAW OF TORTS

1. Nuisance: Nuisance refers to the unreasonable interference with a person’s use or enjoyment of their property. 2. Trespass: Trespass occurs when someone enters or interferes with another person’s property without lawful permission. It can involve both physical entry and the intrusion of other rights, such as airspace or underground resources.

TRESPASS	NUISANCE
Trespass refers to the unauthorized entry onto someone else’s property or land. It involves physically intruding onto another person’s property without permission or lawful right to do so.	Nuisance, on the other hand, involves actions that interfere with another person’s use or enjoyment of their property. This interference might be through either negligent or intentional actions.
It can include actions such as walking across someone’s land without permission, placing objects on their property, or entering a building without authorization.	Private nuisance refers to actions that interfere with an individual’s use or enjoyment of their property. This could include excessive noise, odors, pollution, or any other activity that disrupts someone’s ability to enjoy their property.
