CASE LAWS MASTERCLASS: LAL CHAND V. UNION OF INDIA: COMPARABLE SALES METHOD

CASE LAW STUDY NOTES

EPISODE-3

CASE 2: LAL CHAND V. UNION OF INDIA

CORE CONCEPT: COMPARABLE SALES METHOD

आज का Case आपके लिए बहुत important है, क्योंकि यह सीधे आपके Practical Valuation work से जुड़ता है – Comparable sale, Location, time gap, size, nature of land, genuineness और adjustment से!

Judgment: 12 August 2009, Civil Appeal No. 4945 of

    • Supplementary drain
    • Sewage treatment plant
    • Nangloi drain remodelling
    • Planned development of Delhi

Part 3 – Issue

  • Sub-Questions:
    1. क्या Sale genuine है?

Part 4 – Comparable Sales Method

(IBBI Trap)

5 Score Tests

┌───────────────────────────┐

│ Comparable Sale – 5 Tests │

└─────────────┬─────────────┘

2.       Proximity in time: Sale transaction relevant notification date

3.       Proximity in situation: Property, recquired land

4.       Similarity of land: Land

Test 1: Genuineness of Transaction

  • Distress sale
  • Special relationship
  • Undervaluation

Valuer’s Question: “क्या यह transaction market value को honestly represent करती है?”

Test 2: Time Proximity

  • Subject property valuation date: 1 January 2020
  • Comparable Sale A: 15 December 2019
  • Comparable Sale B: 10 January 2012

Test 3: Situation / Location Proximity

(Remember: Distance की importance context-dependent है – Rural not equal to Urban)

Example:

  • Subject Property: Main road, Area=10,000  sq ft , developed locality.
  • Comparable A: 30 metres away, Main road, Similar size, Similar development.
  • Comparable B: 1 km away, Interior road, No frontage, Large agricultural parcel.

केवल distance देखकर A/B decide नहीं करेंगे, लेकिन  A mein Situation, frontage, development और size ज्यादा Similar हो सकते हैं।

Principle: Similar beats mere distance!

Test 4: Similarity of Land

Test 5: Size

  • Subject: 10,000  sq ft.
  • Comparable: 1,000 sq ft

क्या दोनों का Rs/sq. ft. rate automatically same होगा?

  3. Situation
  4. Potential
  5. Similarity
  6. Differences

Valuer Language: Comparable evidence must be demonstrated, not merely produced.

Part 9 – “Exemplar”

Exemplar hona not equal to Automatically Reliable Exemplar

Part 10 – Undervalued Sale Deed

Important Rules:

  • Low Price not equal to Automatically wrong Dono ko evidence से test करना होगा)
  • High Price not equal to Automatically correct

Part 11 – Distress Sale

Distress Sale.

Part 12 – Adjustment

  • Subject Property: Rs. 10,000/sqft potential market  indication required.
  • Comparable Sale: ₹12,000 /sq. ft.
    • Comparable Characteristics: Better road frontage, smaller plot, better developed locality.

Part 13 – Positive & Negative Factors

Supreme Court ke discussed principles mein comparable property ko Subject property ke sath juxtaposition mein rakhkar suitable adjustment ki bat aati hai.

Juxtaposition = दो चीजों को साथ रखकर Comparison करना .

Factors of Comparable relative to Subject:

Positive Factors (Subject higher value) Negative Factors (Subject lower value)
1. Smaller size 1. Larger area
2. Road proximity 2. Interior location
3. Road frontage 3. Narrow frontage
4. Developed area के पास 4. Lower level
5. Regular shape 5. Developed locality
6. Better level 6. Purchaser-deterring disadvantage

Valuation Report mein agar comparable hein :

Factor Subject Property Comparable Sale
Road Main Road Main Road
Size 10,000  sq ft 2,000  sq ft.
Development Good Excellent
Frontage 60 ft 100 ft
Distance — 100 m/
Date Valuation date 2 months earlier

Now, as a professional valuer: Can you apply the comparable unit rate to the subject without adjustment?

Answer: No , Identify differences than Adjustment – Reconciled indication – Final Opinion. i.e Professional reasionong .

Part 15 – IBBI Traps to Watch Out For

  • Trap 1 Question: “Comparable Sale method requires the comparable property to be identical to the subject property.”
    • Answer: Wrong.
    • Identical: Same to same (Real estate में Identical property practically uncommon है).
    • Therefore: Comparable not equal to Identical.
  • Trap 2 Question: “The nearest property is always the best comparable.”
    • Answer: Wrong. Nearest not wqual to Most Comparable., Location के साथ: Time, size, nature, use, access, development, frontage, shape आदि भी देखना होगा।
  • Trap 3 Question: “Highest sale price should always be adopted.”
    • Answer: Wrong.
  • Trap 4 Question: “All sale deeds in the same village are equally comparable.”
    • Answer: Wrong.

Part 16 – Reasoning of  Lal Chand Case

Framework Step Lal Chand Analysis
Facts Rithala land acquisitions; conflicting Sale values.
Parties Lal Chand & other landowners vs. Union of India.
Law / Principles Land Acquisition Act principles + Prior SC valuation principles.
Evidence Multiple Sale Deeds / Exemplars.
Arguments  Low sales undervalued/distress vs.  High sales artificial.
Reasoning Genuine, time, location, similarity, size + surrounding circumstances.
Decision Reliable sale evidence with appropriate analysis and adjustment to be considered.
Ratio / Principle Comparable Sale requires meaningful comparability; mere production/proximity is insufficient.
Valuation Connection Comparable selection + adjustment + evidence-based reconciliation.

Part 17 – Practical IBBI-Style Scenario Case

Situation:

  • Subject land = 20,000 sq ft
  • Notification Date = 1 January 2020
Feature Sale A Sale B Sale C
Date 15 December 2019 10 December 2019 15 January 2012
Distance 500  m away 100 m away 50  m away
Size 2,000  sq ft 20,000 sq ft 20,000 sq ft
Location Main Road Interior road Main Road
Development Developed locality Less developed Developed
Genuineness Genuine transaction Genuine transaction Genuine transaction

Time + Location + Size + Nature + Development+ Access+ Frontage + Genuineness transaction  Phir Appropriate Adjustment/Reconciliation यह Lal Chand की Thinking है!

Part 18 – Important Vocabulary List

Word Simple Meaning Word Simple Meaning
Exemplar Reference / comparable sale Potentiality
Comparison

Part 19 – IBBI Trap MCQs & Self-Test

    • (a) क्योंकि हर registered sale automatically Market value बनाती है।
[Correct]
    • Ans: No, Situation, nature, size, time, development
    • Ans: No. Sale property
  6. Comparable sale के rate/sq.ft.
