CASE: GUJARAT

NEW GDCR says that Property near Railway line needs Railway NOC

Alike properties near airport needs Airport NOC

Subject property is 8 meters from the Railway Line

As per GDCR Property falling in 30 meter needs to take NOC and NOC would be issued when any Construction is planned.

Present situation is valuation is asked for land part only hence , property is having this issue of markatebility due to the NOC points for future buyers.

OPINION NO-1

Please note the distance of 30 mtr is from the railway land boundary and not from the railway line , all properties which are within 30 mtr have to take permission from railways and then the local DCR has to be applied considering the height allowed by DCR and railway , generally the height allowed is twice the distance from the railway boundary and building line , some authorities don’t allow any construction up to 3.6mtr from railway boundary but this needs to be verified as per local DCR rules prevailing , you may refer the GDCR for further clarification
