CREATION OF EASEMENTS
An easement can be created or acquired either by a owner or a person in possession on his behalf or by a co-owner, if any, for the beneficial enjoyment of the property. A lessee of a leasehold property cannot create or acquire an easement in or over the leased property for the beneficial enjoyment of his own property In a same way, a tenant with permanent rights of tenancy cannot create or acquire an easement by prescription in other lands of his owner.
An easement is created or acquired in many ways. Following are the different methods of creating or acquiring an easement:
An easement is a legal right to use someone else’s land for a specific purpose. There are several methods of creating or acquiring an easement, including:
- Express grant: An easement can be created by the owner of the land by explicitly granting it to another person or entity through a written agreement or deed.
- Express reservation: An easement can also be created when a property owner sells or transfers their land to another person or entity but reserves the right to use a portion of the land for a specific purpose.
- Prescription: An easement can be acquired through prescription, also known as adverse possession. If a person uses another person’s land openly, continuously, and without the owner’s permission for a certain period of time, they may be able to claim an easement by prescription.
- Necessity: An easement can be created by necessity when there is no other way for a landowner to access their land other than crossing another person’s land. This type of easement is often created when a landlocked property is sold or divided.
- Easement by implication: An easement can be created by implication when it is necessary for the reasonable use and enjoyment of a property. For example, if a landowner sells a portion of their land and retains the remaining land, an easement may be implied for the benefit of the retained land to access a road or utility lines.
- Easement by estoppel: An easement can be created by estoppel when a property owner leads another person to believe that they have the right to use their land for a specific purpose and that person relies on that belief to their detriment.
These are some of the methods of creating or acquiring an easement, but the laws and regulations regarding easements can vary by state or jurisdiction. It’s important to consult with a legal professional to understand the specific requirements and procedures for creating or acquiring an easement in your area.
