UNDERSTANDING VARIOUS BLOOD RELATIONS AS PER HINDU SUCCESSION ACT, 1956

The Hindu Succession Act, 1956, outlines the rules for inheritance and succession among Hindus. In terms of blood relations, it categorizes them into different degrees, and these are essential for determining inheritance rights.

  • Full Blood: Relatives who share both parents with the deceased and have the highest priority in inheritance.
  • Half Blood: Relatives who share only one parent i.e. father with the deceased and are given priority after full blood relatives but before uterine blood relatives.
  • Uterine Blood: Relatives who share only the same mother with the deceased but not the same father, and have the lowest priority in inheritance.

This hierarchy helps in determining the rightful heirs when a person dies intestate (without a will) under Hindu law.

Below is a detailed comparison of full blood, half blood, and uterine blood relations according to the Hindu Succession Act, 1956:

Criteria Full Blood Half Blood Uterine Blood
Meaning Individuals who share both parents (both father and mother) with the deceased. Individuals who share only one parent with the deceased, either the father or the mother. Individuals who share only the mother with the deceased, but not the father.
Preference in Succession Full blood relatives have a higher priority in succession compared to half blood and uterine blood relatives. Half blood relatives are considered after full blood relatives but before uterine blood relatives. Uterine blood relatives are considered last in the line of succession among these categories.
Example Full brothers and sisters. (SAME MOTHER AND FATHER) Half-brothers and half-sisters (sharing the same FATHER but different MOTHERS). Uterine brothers and sisters (sharing the same mother but different fathers).
Legal Status Full blood relatives are given precedence in inheritance laws and are considered first for succession. Half blood relatives are recognized but are not given precedence over full blood relatives. Uterine blood relatives are the last category considered for inheritance under Hindu law.
