Ten Case Laws relevant to panel valuers in the observation of the courts :

1. A valuer is not an expert to test the genuineness of the documents. –
L.N. Rajagopalan Vs State – CRL.R.C.No. 1063 of 2008 – Madras High court 10.08.2009.

2. A valuer is not competent to certify the genuineness of the title. – Vijay Kumar Singh Vs State of Bihar – Cr. Misc. No. 27162 of 2011 (6) Patna High court – 10.12.2013.

3. A valuer is not responsible to detect the forged document. – Aparna Das Vs Banks – W.P.No. 22699 (W) of 2014 – Kolkatta High court – 19.08.2014.

4. A valuer has no role or verify the title of the documents. – Hemraj Phonsa Vs CBI – Court of Special Judge – Anti corruption – (CBI) – Jammu & Kashmir – 11.12.2015.

5. Mere negligence would not make a professional for a criminal offence in the absence of tangible evidence. – A Kumar Sharma Vs CBI CRL.M.C. 3302/ 2013 – 09.02.2015 – Delhi High court.

6. Liability against a professional arises only when he is an active participant in a plan to defraud the bank. – CBI Vs K. Narayana Rao — (2012) 9 SCC 512

7. Blacklisting a valuer cannot be done just like that without following the procedure and principle of natural justice. – Mohanty & Associates W.P. (C) No. 10647 of 2014 – Orissa High court – Cuttack – 29.09.2014.

8. The bank can refer any valuer to the IBA’s caution list, only after following the guidelines. – W.P. (MD) No. 5404 of 2011 – Madras High court – 02.11.2011.

9. In the matters of “contract”, unless the orders are wholly arbitrary or unreasonable, the court will decline to exercise its jurisdiction. – R. Anbalagan Vs Central Bank of India – Madras High court – Writ Appeal No. 728 of 2015

10. The valuer cannot quote any internal correspondence (it may be confidential also) of the bank for representing his grievances against the bank. – Sri. Gorur Srinivas Vs CBI – Karnataka High court – 02.12.2014.
