Professional Competence and Due Care

To maintain professional knowledge and skill at the level required to ensure that a client or employer receives competent professional services based on current developments in practice, legislation and techniques and in accordance with applicable technical

Professional Competence

It is the habitual and judicious use of communication, knowledge, technical skills, clinical reasoning, emotions, values and reflection in daily practice for the individual or community being served

Competence builds on a foundation of basic clinical skills, scientific knowledge and moral development

Competence depends on habits of mind, including attentiveness, critical curiosity, self awareness and presence

Professional competence is developmental, impermanent and context dependent

Due Care

It refers to the effort made by an ordinarily prudent or reasonable party to avoid harm to another, taking the circumstances into account

It refers to the level of judgment, care, prudence, determination and activity that a person would reasonably be expected to do under particular circumstances

Advantages of Professional competence and due care

1) the degree of utilization of knowledge, skills and the good judgement related to the people’s profession and in correspondence with all the situations that can be lived in the exercise of professional practice

2) the broad professional knowledge, attitude and skills required in order to work in a specialized area or profession

3) the educational result reflected in readiness to perform a certain practice in the professional sphere, on the basis of a system of knowledge, skills and experience of the learners

4) it is related to people or work teams, integrating technical, cognitive, social and affective aspects related to work

5) it comprises knowledge, skills and attitudes or behaviours that will allow the organization’s development

6) a learning outcome implying the ability and readiness to perform a certain daily professional practice

Importance of due care

Due care is important because it’s not fair to put other people at unreasonable IDK of harm due to one’s failure to take care

Due care is the conduct that a reasonable person will exercise in a particular situation, in looking out for the safety of others

Law definition for failure of person to use due care

Specifically negligence is the failure of a person to use due care in a certain situation, failing to act as another average person would have done

Due care – means precautions required by law

ie when someone fails to take necessary precautions and some negative outcome occurs, they can be held liable by law

Due care has been taken when an organization makes sure that every employee knows what is acceptable or unacceptable behavior and knows the consequences of illegal or unethical actions

Due Diligence

It is the investigation or exercise of care that a reasonable business or person is normally expected to take before entering into an agreement or contract with another party or an act with a certain standard of cate

Due diligence is an investigation, audit or review performed to confirm the facts of a matter under consideration

Declaration to be given by Valuer in his Valuation Report

1) I shall render at all times high standards of service, exercise due diligence, ensure proper care and exercise independent professional judgement

2) I shall carry out professional services in accordance with the relevant technical and professional standards that may be specified from time to time

3) I shall continuously maintain professional knowledge and skills to provide competent professional service based on up to date developments in practice, prevailing regulations, guidelines and techniques

4) in the preparation of valuation report, I shall not disclaim liability for his/its expertise or deny my duty of care except to the extent that the assumptions are based on statements of facts provided by the company or it’s auditors or consultants on information available in public domain and not generated by me

5) I shall not carry out any instruction of the client in so far as they are incompatible with the requiements of integrity, objectivity and independence

6) I shall clearly state to his client the services that I would be competent to provide and the services for which I would be relying on other valuers or professionals or for which the client can have a seperate arrangements with other valuers
